Your rights

Mandatory consumer law always takes priority

Section 1

Parties, scope and acceptance

These terms form an agreement between the user and MASTERINK TATTOO SL, Tax ID B26629790, whose registered office is at Prolongación Ronda Santo Domingo, 2, 4.º H, 03300 Orihuela (Alicante), Spain, for access to and use of masterink.art and the purchase of its products and services.

Masterink is the seller and is responsible for the purchased service. Shopify and other technology providers supply infrastructure but do not replace Masterink as the customer's contractual counterparty.

By completing a purchase or creating an account to access training, the user accepts these terms, the specific offer displayed before payment and the applicable policies. Product-specific terms prevail within their scope, and nothing here reduces mandatory consumer rights.

Section 2

Capacity, registration and account

To purchase, users must be at least 18 and have legal capacity. A minor may only use the services with the permission and supervision of a legal representative, who will enter into the contract where required by law.

The information supplied must be accurate, complete and kept up to date. Users are responsible for safeguarding their login details and must notify Masterink without delay if they detect unauthorised access.

Accounts and course access are personal. They may not be sold, assigned, sublicensed or shared with third parties unless Masterink has expressly authorised this in writing or the offer states otherwise.

Section 3

Electronic contracting

Before payment, the checkout allows users to select the product, review its features, final price and entered data, correct errors and accept the applicable terms. The final button makes it clear that placing the order entails an obligation to pay.

An order is a request to purchase. The contract is concluded when Masterink confirms acceptance electronically. Masterink may reject or cancel an order due to fraud, inability to supply, an obvious pricing error or breach, informing the customer and promptly refunding any payment where appropriate.

The contract may be completed in the language selected while browsing. Masterink or its providers retain an electronic record of the purchase and send confirmation to the address supplied, normally immediately and in all cases within the applicable statutory period.

These terms can be printed or saved before purchase. The version in force and accepted on the order date applies to that purchase together with the description and any specific terms displayed during checkout.

Section 4

Services and the content of the offer

Masterink provides online tattoo education through courses, seminars, masterclasses, video, audio, subtitles, downloadable materials, sessions, learning tools and, where stated, community or support features.

The content, duration, instructors, language, requirements, access model, included materials and any physical items for each purchase are those described on the product page and in the order summary. The advertising and offer in force when purchasing form part of the contract.

Training is educational. Unless expressly stated, it is not an official academic qualification, professional licence, health authorisation or permit to practise. Students must comply with the professional, hygiene, health and administrative rules that apply in their territory.

Section 5

Prices, taxes and payment

The final price, currency, taxes and any applicable additional charges are displayed before the order is confirmed. Pricing may be adapted to the user's country or market; the amount in the final checkout summary is binding.

Masterink may change prices and promotions for future purchases, but changes will not affect confirmed orders. Promotion terms apply while the promotion is valid and cannot be combined unless expressly stated.

Users confirm that they are authorised to use the selected payment method. Payments, instalments or financing may be processed by third parties under their own terms, without limiting Masterink's obligations to the consumer.

Section 6

Access, requirements and continuity

Digital access is enabled after payment is confirmed or on the date stated in the offer. Users need an internet connection, a valid email address and a device and browser reasonably compatible with the disclosed requirements.

Access is personal and permits content to be viewed as many times as the offer allows. Materials identified as downloadable may be retained for personal use; being able to view a resource does not mean it may be downloaded, copied or redistributed.

Where the offer states lifetime access, access is indefinite, does not expire merely with the passage of time and does not incur recurring access fees. The specific scope advertised and accepted on the purchase date always prevails.

Masterink may maintain and update technology or content for legal, security, quality or teaching reasons without unjustifiably degrading the purchased service. If a substantial interruption or change affects access, reasonable advance notice will be given where possible and the remedies or solutions required by law will be offered.

Section 7

Intellectual property and licence

The trade marks, video, audio, text, photographs, designs, methods, learning materials, software and other content belong to Masterink or its licensors and are protected by intellectual and industrial property law.

A purchase grants only a limited, personal, non-exclusive, non-transferable licence, revocable for material breach, to access and use the content for the student's own learning. No ownership or exploitation rights are transferred.

Unless permitted by law or in writing, content may not be reproduced, recorded, extracted, distributed, communicated publicly, altered, sold, sublicensed, shared or otherwise made available. Permitted copies of downloadable materials must retain authorship notices and be used only by the student.

Section 8

Comments and user content

Users retain the rights to comments, exercises, images and other material they submit and warrant that they may share it and that it does not infringe third-party rights. Personal data or images of others must not be posted without a valid legal basis or permission.

By posting within the service, users grant Masterink a non-exclusive, royalty-free licence limited to hosting, technically reproducing, moderating and displaying that content to operate the service. Advertising, testimonial or external campaign use requires separate specific permission unless the user expressly submitted it for that purpose.

Section 9

Prohibited conduct

Users must use the services lawfully, carefully and respectfully towards Masterink, instructors and other students. They must not interfere with the platform or bypass access or security measures.

In particular, the following conduct is prohibited:

  • Sharing credentials, giving third parties access or using another person's account.
  • Copying, recording, bulk downloading, reselling or redistributing content without permission.
  • Scraping, reverse engineering, automated extraction or bypassing technical safeguards.
  • Introducing malware, overloading the service or attempting unauthorised access to systems, data or accounts.
  • Posting unlawful, deceptive, discriminatory or threatening content, or content that infringes third-party rights.
  • Using the services for fraud, impersonation, unlawful activity or practices that endanger others.

Section 10

Providers, links and affiliates

Masterink uses providers such as Shopify, payment gateways, video hosting, email, analytics and other tools needed to supply the services. Each provider may apply its own terms to any direct technical relationship it has with the user.

Masterink remains responsible to the customer for its own obligations as seller. It is not responsible for interruptions or acts solely attributable to third parties outside its reasonable control, without prejudice to rights that the law gives consumers against Masterink.

External links are provided for convenience and do not endorse their content. Affiliate or partner programmes, when available, are also governed by their specific terms, which prevail only within that programme.

Section 11

Diplomas and physical items

Where an offer includes a diploma, issue may depend on completing progress, assessments or other requirements stated in the course. A diploma certifies private training and is not an official qualification or professional licence unless the offer expressly says so.

A physical copy, if offered, may require a separate request, shipping details and payment of charges shown before confirmation. Delivery times are estimates and may vary by destination, carrier and customs procedures.

A physical item does not change the mainly digital nature of the training. The shipping policy and applicable statutory delivery, conformity and withdrawal rights also apply to physical goods.

Section 12

Withdrawal, returns and refunds

Where the buyer is a consumer, they generally have fourteen calendar days from conclusion of a distance contract to withdraw without giving a reason, unless a statutory exception applies.

For digital content not supplied on a tangible medium, the right of withdrawal is lost after performance begins only where the consumer expressly consented to performance beginning during the withdrawal period, acknowledged that this causes the right to be lost and Masterink supplied the required statutory confirmation.

Masterink may offer additional or more favourable commercial refund guarantees subject to time, progress or download limits clearly set out in the offer and refund policy in force when purchasing. Those guarantees are additional to statutory rights and never replace or reduce them.

To request withdrawal or a refund, customers may email team@masterink.art with their purchase details and an unequivocal statement. Eligible refunds are made using the same payment method unless expressly agreed otherwise, within the statutory or applicable guarantee period.

Section 13

Conformity and statutory guarantees

Digital content and services must match the description, functionality, quality, compatibility, accessibility, continuity and other characteristics reasonably expected under the contract, offer and applicable law.

If there is a lack of conformity attributable to Masterink, consumers may require the service to be brought into conformity free of charge and, where legally available, a price reduction or termination, together with any other applicable rights.

For digital content or services supplied in a single act or separate acts, statutory liability for lack of conformity lasts two years from supply. For continuous supply over a period, liability continues throughout the contracted period, without prejudice to any longer period or later change in law.

Section 14

Suspension and termination

Masterink may restrict or suspend access where there are reasonable indications of fraud, a security risk, non-payment, account sharing, intellectual-property infringement or breach of these terms. Any measure will be proportionate to the seriousness and duration of the breach.

Where reasonably possible, Masterink will notify the user and give them an opportunity to remedy the breach. It may act immediately in response to serious or unlawful conduct or conduct that compromises security, third-party rights or service continuity.

Suspension or termination does not remove any refund, remedy or right due to a consumer by law. Users may stop using the service and request account closure, but this does not automatically create a refund outside applicable statutory or commercial cases.

Section 15

Availability, outcomes and liability

Masterink takes reasonable measures to keep the service secure and available, but maintenance, technical incidents, providers or force majeure may cause interruptions. It will seek to restore access within a reasonable time and communicate material interruptions where possible.

Learning, professional and financial outcomes depend on each student's practice, ability and circumstances. Masterink does not promise income, employment, artistic level or a specific result, but it must supply the content and service at the promised quality and conformity.

Masterink is not responsible for failures caused solely by a user's device, connection, incompatible software or use contrary to instructions, provided technical requirements were clearly disclosed. Nor is it responsible for unsafe or unlawful professional use by a student.

Nothing excludes or limits liability for fraud, negligence where it cannot legally be limited, attributable personal injury, breach of essential obligations, lack of conformity or any other mandatory consumer right.

Section 16

Privacy and communications

Masterink processes personal data needed to manage accounts, orders, access, support, fraud prevention and legal compliance as explained in its privacy policy. Cookie and marketing preferences can be managed through the available controls.

Operational communications concerning orders, security, essential changes or service delivery are not advertising and may be necessary to perform the contract. Marketing is sent only where there is an appropriate legal basis and users may unsubscribe at any time.

Section 17

Changes to the terms and service

Masterink may update these terms for regulatory, technical, corporate or service changes. A new version applies to future purchases from publication and will show its update date.

A change will not retroactively reduce the rights or benefits of a confirmed purchase. For continuous services, contractual changes apply only for valid grounds allowed by law, at no additional cost and with clear, reasonable advance notice where they materially affect the user.

If the law gives consumers a right to terminate because a change adversely affects access or use, Masterink will explain that right and how to exercise it. Updates needed for conformity, security or legal compliance may be applied as permitted by law.

Section 18

Governing law, complaints and jurisdiction

These terms are governed by Spanish law without depriving consumers of mandatory protection available under the law of their country of habitual residence.

Before using other channels, users may submit a complaint to team@masterink.art to seek a direct solution. They may also contact the competent public consumer bodies or available alternative dispute-resolution mechanisms.

Where the user is a consumer, the courts designated by mandatory rules have jurisdiction, including the courts of the consumer's domicile where applicable. For business-to-business or professional relationships only, and where legally permitted, the parties submit to the courts of Orihuela (Alicante), Spain.
